Introduction

These terms and conditions apply between you, the User of this Website and The ClassicCouture Ltd, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of this Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, ‘User’ or ‘Users’ means any third party that accesses the Website and is not either (i) employed by The ClassicCouture Ltd and is acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to The ClassicCouture Ltd and accessing the Website in connection with the provision of such services.

Intellectual Property and Acceptable Use

  1. All content included on this website is the property of The ClassicCouture Ltd, our affiliates or other relevant third parties. In these terms and conditions, ‘Content’ means any text, graphics, images, audio, video, software, date compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website. By continuing to use this Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on this site without the owner’s prior written permission.

  2. You may, for your own personal, non-commercial use only, do the following:

 (a) retrieve, display and view the Content on a computer screen

 3. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of The ClassicCouture Ltd.

Online Ordering

 4.  You can place an order if you are an adult aged 18 or over. Payment is received either via Paypal, which is our default payment method, or via Bank Transfer. If you would like to pay via bank transfer please contact us via email       and let us know what item you wish to purchase and then we will provide you with the relevant bank details and             invoice to complete this purchase.

 5. The ClassicCouture Ltd retains title in the sold goods until we have received full payment of the price.

 6. We reserve the right to cancel your order for any reason.

Sale Contract

 7. No sale contract will exist between you and The ClassicCouture Ltd until The ClassicCouture Ltd dispatches the            products. Your order represents a binding offer by you to purchase our products. The sale will only be binding on us      once we have notified you by E-mail that the goods have been dispatched to you.

 8. The ClassicCouture Ltd reserves the right to refuse an order, wholly or partially, in the following cases:
• If the product is not available;
• If your billing information is not correct or not verifiable;

• If we could not deliver to the address provided by you.
• If your bank transfer payment is not received timely;
• If we have reason to believe you are under 18;
• If there was an error in the price quoted;

Prices

 9. The price of the products you order is the price that is displayed on the Site at the time you confirm your order and will be confirmed on the e-mail confirmation confirming receipt of your order. All prices are in £, inclusive of VAT and forwarding charges.

10. If an error is found in the price of the products you have ordered we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund you for the sum that has been debited from your account for the products.

Delivery

 11. All purchased goods are sent via a secure and tracked shipping service. Once your order has been dispatched you will receive an email from us informing you of this and providing you with a tracking number in order for you to track the movement of your goods. All goods are eligible for free UK postage. Worldwide shipping is also available at a flat rate of £20 per item.

Returns

 12. If you are not satisfied with your item and therefore would like to return it then you must get in touch with us via email within 14 days of receiving the item, providing that the item has not been used by you in any way shape or form. After this 14 day time period, goods can no longer be returned under any circumstances.

 13. If  you are within this 14 day period and want to return an item then you must:

  (a) send us an email to notify us of your desire to return the product and once we respond with acknowledgement of           your desire to return;

  (b) then you must send the goods back via a secure, tracked shipping service.

  (c) All returns postage is paid for at the buyers expense.

  (d) Once you have shipped the item you must then email us the tracking code so that we can follow its return.

  (e) Once we have received the return, we will then refund your money via your original payment method.

  (f) Any goods that are sent back not using a secure tracked shipping service are sent back at the buyers risk and therefore if these are not received, the buyer is liable and a refund will not be provided.

 14. We aim to refund buyers within 14 working days of receiving the return.

 16. We assume no responsibility for the content of such Websites and disclaim liability for any and all forms of loss or damage arising out of the use of them.

Availability of the Website and Disclaimers

 18. Any online facilities, tools, services or information that The ClassicCouture Ltd makes available through the Website (the service) is provided “as is” and on an “as available” basis. We give no warranty that the service will be free of defects and/or faults. To the maximum extent permitted by the law, we provided no warranties (expressed or implied) of the fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. The ClassicCouture Ltd is under no obligation to update information on this Website.

 19. Whilst The ClassicCouture Ltd uses reasonable endeavours to ensure that this Website is secure and free of errors, viruses and other malware, we give no warranty or guarantee in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

 20. The ClassicCouture Ltd accepts no liability for any disruption or non-availability of the Website.

 21. The ClassicCouture Ltd reserves the right to alter, suspend or discontinue any part (or the whole of) this Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of this Website unless it is expressly stated otherwise.

Limitations of Liability

 22. Nothing in these terms and conditions will (a) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (b) limit of exclude any of our or your liabilities in any way that is not permitted under applicable law.

 23. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

 24. To the maximum extent permitted by the law, The ClassicCouture Ltd accepts no liability for any of the                            following:

 (a) any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities:

 (b) loss or corruption of any data, database or software;

 (c) any special, indirect or consequential loss or damage.

General

 25. You may not transfer any of your rights under these terms and conditions to any other persons. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

 26. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

 27. These terms and conditions contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the              terms and conditions.

 28. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

 30. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

 31. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement shall be subject to the exclusive jurisdiction of the English and Welsh courts.
